JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Barsoi P.S. Case No. 165 of 2017 instituted for the offence under Sections 147,148,149,341,323,506,307,302,427,120B of the IPC. As per written report, there is specific allegation against this petitioner of assaulting the husband of informant along with other accused persons with lathi, danda etc. due to which, husband of the informant subsequently died. The post-mortem report is available in the case diary, where, doctor has opined that death has been caused by injuries sustained by hard and blunt substance.
In such circumstances, this Court is not inclined to grant anticipatory bail to this petitioner. Accordingly, the
Patna High Court Cr.Misc. No.58320 of 2017 (3) dt.18-01-2018 2/2 anticipatory bail petition stands rejected.
The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law without being prejudiced by this order.
