Petitioner seeks pre-arrest bail in Complaint Case No.919 of 2017 registered under Section 498(A) of I.P.C. and Section 4 of Dowry of Prohibition Act.
Allegation against the petitioner is of torture and harassment to his wife due to non-fulfillment of dowry demand. Submission on behalf of the learned counsel for the petitioner is that earlier also the petitioner had filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal life.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1363 of 2019(2) dt.18-01-2019 2/2 circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, let him surrender before the learned court below within six weeks from today and on his so surrendering he will be released on provisional bail for three months to the satisfaction of the court below. In the meantime, the learned court below shall issue notice to O.P.No.2 and try to reconciliate them and after reconciliation, if the petitioner is found not at fault, and he is ready to keep her, bail bond of the petitioner shall be confirmed otherwise he may pass an appropriate order or orders.
