It has been reported by the Stamp Reporter that the restoration petition has been filed with respect to L.P.A. No. 1325 of 2005 stated to have been dismissed for default on 03.08.2007 whereas there was no such order passed in said Letters Patent Appeal and as a matter of fact L.P.A. No. 1325 of 2005 has been permitted to be withdrawn by order dated 01.12.2008. In the above circumstance, the restoration application appears to be not maintainable. It is, accordingly, dismissed as not maintainable.
