The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that under the Govt. rule paddy was purchased by this petitioner and was kept at the place of occurrence and complainant being PACS Chairman was made to have vigilant over the stored paddy. It is further alleged that the petitioner in absence of the complainant took away the paddy i.e., 1494 bags measuring 597.60 quintals by three trucks without knowledge of the complainant.

Patna High Court CR. MISC. No.513 of 2022(2) dt.26-07-2022 2/2 It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that FIR of Khizersarai P.S. Case No. 116 of 2013 on 08.06.2012 was registered in respect of this paddy in question by the petitioner against the informant. He further submits that the said paddy was not recovered from the conscious or constructive possession of this petitioner. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VIII, Gaya in connection with Trial No.23 of 2013 arising out of Complaint Case No.1201 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
