====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 19-10-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State.

2. Petitioner apprehends his arrest in connection with Rajnagar P.S. Case No. 147 of 2023 dated 13.6.2023 registered for the offence punishable under Sections 143, 341, 323, 307, 380, 448, 427, 504 and 506 of the Indian Penal Code.

3. As per the First Information Report, while the informant was talking to his landlord on 12.6.2023 the petitioner along with other accused persons arrived there, assaulted him and looted some valuable articles from the

Patna High Court CR. MISC. No.64126 of 2023(2) dt.19-10-2023 2/3 house of the informant. It has further been alleged that the petitioner assaulted the informant by means of cricket stump on his head due to which he sustained injury.

4. Learned counsel for the petitioner submits that the informant is a tenant of the neighbour of the petitioner and used to raise noise in the night which was being objected by the side of the petitioner. Learned counsel further submits that there is delay of one day in lodging the First Information Report. He next submits that the injury caused to the informant is simple in nature as would be evident from Annexure-2 to the bail application.

5. Regards being had to the submission made by the parties and taking into consideration the fact that both the parties are of the same village residing adjacent to each other and the injury caused to the informant is simple in nature, I am inclined to grant anticipatory bail to the petitioner.

6. Accordingly, in the event of arrest or surrender before the learned court below within six weeks from today, petitioner, above named, shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand)

No.64126 of 2023(2) dt.19-10-2023 3/3 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Madhubani, in connection with Rajnagar P.S.
