Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Samastipur Muffasil P.S. Case No. 17/2021 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2018.

As per allegation, the police party intercepted a 'Scorpio' vehicle. Three persons began to flee away after getting down therefrom. One was apprehended. He disclosed his name

No.486 of 2022(2) dt.31-05-2022 2/3 as Manish Kumar and also disclosed the name of the persons, who became successful in fleeing away, as Rajeev Kumar Singh @ Chhotu and Amarjeet Kumar Jha, the present petitioner. The illicit liquor was recovered from that scorpio vehicle. The learned counsel for the petitioner has submitted that the petitioner is under custody since 12.08.2021. There is nothing against him save and except the confessional statement of co-accused. Manish Kumar, who was apprehended at the spot and on whose confessional statement, the name of the petitioner figured, has been granted bail in Cr. Misc. No. 29536 of 2021 as mentioned in paragraph 9 of this bail petition. Considering the above-mentioned facts and circumstances, the petitioner above-named is directed to be released on bail only after framing of charge on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge (Excise), Samastipur in connection with Samastipur Muffasil P.S. Case No. 17/2021.

The trial Court is directed to take every endeavour to frame the charge within three months.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove,
