2. The petitioners apprehend their arrest in connection with Bihta P.S. Case No. 228 of 2004 registered under Sections 147, 148, 149, 302, 201 of the Indian Penal Code lodged on 07.09.2004 by the informant, Nawlakh Singh.
3. As per the First Information Report, the FIR lodged in the year 2004, the allegation is of killing of the 85 years old father of the informant and later his dead body was traced from the Sone river. The allegation amongst other was against these petitioners. Accordingly, the FIR.
4. Learned counsel for the petitioners submit that the
Patna High Court CR. MISC. No.65163 of 2023(3) dt.29-02-2024 2/2 police investigated the matter and submitted final form but later cognizance was taken.
5. On specific query as to when cognizance was taken, there is no reply.
6. Learned APP for the State points out that even the rejection order of the Sessions Judge is of the year 2021 inasmuch as it was rejected on 18.01.2021 and almost three years later, the present anticipatory bail application.
7. It would be appropriate that the petitioners surrender and seek bail. No case of anticipatory bail is made out.
8. Accordingly, the anticipatory bail of the petitioners stand rejected.
