JUSTICE RAVI RANJAN ORAL ORDER 10-04-2015 I have heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in connection with Shastri Nagar P.S. Case No. 400 of 2014 registered for offences punishable under Sections 406/420/506 of the Indian Penal Code and 320/325 of Bihar Municipal Act, 2007.

It is submitted on behalf of the petitioner that in fact the building was completed and the owner of the land, i.e., the informant had already sold away her share of the flats which would be evident from Annexure 2 series which is electricity bills for different flats in the building in the name of informant. Informant herself has filed annexure 4 which is a letter dated

Patna High Court Cr.Misc. No.45200 of 2014 (2) dt.10-04-2015 2/2 7.7.2000 to the Vice Chairman, P.R.D.A. stating that the Ground + 3 building has already been constructed and a fresh map is being filed of approval for fourth floor.

It is contended that it shows that the entire story is concocted as the petitioner has already completed the construction work in the year 2000 itself.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Surya Narayan be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Shastrinagar P.S. Case No. 400 of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Patna subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure (Dr. Ravi Ranjan, J) Spd/- U T
