Petitioners seek pre-arrest bail in Kesariya P.S.Case No.286/18 registered under Sections 147. 149, 341, 323, 324, 307, 379, 504 and 506 of I.P.C.

Allegation against the petitioners is of assault to the informant and others.

Submission on behalf of the learned counsel for the petitioners is that there is case and counter case between the parties and injury report does not support the prosecution case. Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the learned court

Patna High Court Cr.Misc. No.79350 of 2018(2) dt.11-01-2019 2/2 below within six weeks from today be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Motihari, East Champaran, in Kesariya P.S.Case No.286/18 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
