====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2023 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8, 20(b)(ii)(c), 25, 29 of the of the Narcotic Drugs and Psychotropic Substances Act.

3. As per F.I.R., two quintals and 1.700 kg Ganja was recovered from truck.

4. Learned counsel for the petitioner submits that petitioner is neither driver nor owner of the truck in question and has got no concern with the alleged recovery. No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner has been made accused on

Patna High Court CR. MISC. No.63914 of 2023(3) dt.06-12-2023 2/2 the basis of confessional statement of driver of vehicle in this case and huge quantity of Ganja has been recovered from the truck in question.

6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
