2. The present application has been filed to modify the order dated 31.07.2023 passed in Cr. Misc. No.37409 of 2023.
3. Learned counsel for the petitioner submits that vide order dated 31.07.2023 passed in Cr. Misc. No. 37409 of 2023, the petitioner was granted bail but, due to typographical mistake, in the tenth line of para 3, it has wrongly been recorded that petitioner has no criminal antecedent, whereas it is mentioned in para 3 of the main bail application that petitioner has two criminal antecedents. He also submits that as the period to surrender has expired the same may also be extended.
4. On the grounds mentioned in the modification
Patna High Court CR. MISC. No.74551 of 2023(2) dt.10-11-2023 2/2 application and in the interest of justice, the order dated 31.07.2023 passed in Cr. Misc. No.37409 of 2023 is modified to the extent as indicated above and further the period to surrender is extended by six weeks from today in connection with Sakatpur P.S. Case No. 22 of 2023, pending in the court of learned Special Judge Excise II, Darbhanga, subject to deposit of Rs.2000/- (Rs. Two Thousand) in the Victim Compensation Fund, Bihar.
5. Accordingly, the order dated 31.07.2023 is modified to the extent as indicated above and this modification application stands disposed of.
