JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This is an application for grant of anticipatory bail in connection with Ghorasahan P.S. Case No. 429 of 2018, disclosing offences under Sections 498(A)/34 of the Indian Penal Code.

Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand. Submission of learned counsel for the petitioner is that he is still ready to keep her and he has filed a matrimonial case also for restitution of conjugal right, but she is not cooperating in the same.

Heard learned A.P.P. as well as learned counsel for the informant, who opposed the prayer for anticipatory bail of the

Patna High Court CR. MISC. No.80330 of 2018(3) dt.07-03-2019 2/2 petitioner stating that she is not ready to reside with the petitioner, rather she wants one time settlement. Having heard both sides, considering the above submission, this application is allowed. Provisional bail granted to the petitioner vide order dated 24.01.2019 is confirmed to the condition that if any case for maintenance is being filed by the opposite party no.2, the petitioner shall cooperate in disposal of the said maintenance case.
