2. The petitioner apprehends arrest in connection with Alamganj P.S.Case No.234 of 2017 pending in the Court of ACJM, Patna City registered for an offence under Section 304B of the IPC.

3. It has been submitted that the allegation of torture in connection with demand of dowry is omnibus. The deceased was a deserted lady and she was residing separately from her husband. The father of the deceased during the life time of her first husband married the deceased with the petitioner and so the question of demand of dowry does not arise. The deceased sustained burn injury accidentally and the petitioner moved her to hospital for better treatment.

4. The learned APP opposed the submissions.

5. It appears that the petitioner is the husband of the deceased and there is specific allegation of torture against him. In case diary, I find that a large number of witnesses have supported the allegation of assault by the petitioner. The deceased died on account of burn injuries in the house of her husband, considering which, I am not inclined to grant anticipatory bail to the petitioner.
