JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-05-2015 Heard the Counsels for the petitioner and the State. The petitioner is facing accusations under Sections 467, 468, 420 and 120B of the Indian Penal Code arising out of Complaint Case No. 1741C of 2010.

According to the complainant, one Dulari Sah got a sale deed executed by him in respect of land which did not belong to him. Learned counsel submits that petitioner is neither the beneficiary of the sale deed nor the witness. He draws attention of the Court to the statement made in paragraph 12. The Court ultimately took cognizance in the year 2012 and issued summons which was not served on them for a long time. In the facts and circumstances of the case, in the event of arrest or surrender in the Court below within four weeks, the

No.46142 of 2014 (3) dt.20-05-2015 2/2 petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jamui in Complaint Case No. 1741C/2010 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions: (I) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner secure his arrest in accordance with law.
