2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 342, 504, 506, 307/34 of the Indian Penal Code.
3. As per proseuction case , petitioner No. 2 along with other co-accused caught hold of son of the informant from behind and co-accused Kedar Das stabbed with knife in abdomen .
4. Learned counsel for the petitioners submits that specific allegation of assault with knife is against co-accused Kedar Das. Petitioner No. 2 is only alleged to have facilitated
Patna High Court CR. MISC. No.64299 of 2023(2) dt.16-10-2023 2/2 the offence by catching hold of the son of the informant. There is no allegation of assault against the petitioners. Petitioner No. 2 is lady and she is alleged to have brought the knife and handed over the same to co-accused Kedar Das.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A . C . J . M. , Lakhisarai in connection with Chanan P.S. Case No. 89 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
