JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 The petitioner apprehends his arrest in connection with Rajepur P.S.Case No. 68 of 2018 registered under Sections 120B and 302/34 of the Indian penal Code.

Allegation as per the FIR is that husband of the informant had gone to the house of Chandan Singh and he did not return. Thereafter when informant along with her father-in-law went to house of Chandan Singh, found 11 persons including petitioner sitting there armed with weapons and they disclosed that he has left the place half an house before. In the next morning, dead body of her husband was found.

Submission of learned counsel for the petitioner is that except suspicion, there is nothing against the petitioner and he was no motive for causing such occurrence and moreover, considering the aforesaid fact, another co-accused has been

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar Motihari, District- East Champaran in connection with Rajepur P.S. Case No. 68 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sujit/- U T
