ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel appearing on behalf of the State.
Petitioner no.1 is the Gotni, petitioner no. 2 is her husband (Bhasur) and petitioner no. 3 is the married sister-inlaw of the deceased are apprehending their arrest in connection with Chakmehsi P.S. Case No. 14 of 2016 for the offences registered under Sections 304B, 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that so far as petitioner nos. 1 and 2 are concerned, they are living separately at Delhi and have no connection with the aforesaid occurrence, as alleged. Petitioner no. 3 is married sister-in-law
Patna High Court Cr.Misc. No.27827 of 2016 (2) dt.05-08-2016 and lives in Muzuffarpur with her family. It is further submitted that petitioner nos. 1 and 3 have no criminal antecedent whereas petitioner no. 2 has been subjected to prosecution by the Chachi of petitioner no. 2 on account of land dispute. It is further submitted that deceased was highly ambitious lady and was dissatisfied with her husband on account of his low income. Learned counsel for the informant submits that the marriage was very recent and soon after the marriage the victim girl has been done to death.
Considering the nature of allegation made against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Chakmehsi P.S. Case No. 14 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
