The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,325,354 and 504/34 of the Indian Penal Code and section 3(1)(x)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The accusations are of assaulting, abusing by calling caste name and making attempt to outrage the modesty of the informant.

It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence under section 354 IPC is made out. Statement has been made in

Patna High Court Cr.Misc. No.36520 of 2015 (2) dt.09-09-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Fatehpur P.S. Case No. 24 of 2015 pending in the court of learned JM Ist Class, Gaya. This application is disposed of with the aforesaid observation/direction.
