IN THE HIGH COURT OF JUDICATURE AT PATNA

CIVIL MISCELLANEOUS JURISDICTION No.488 of 2016 ====================================================== Dinesh Singh .... .... Appellant/s

Versus

Ranju Devi .... .... Respondent/s ====================================================== Appearance :

For the Appellant/s : Mr. Parijat Saurav For the Respondent/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner.

2.

Perused the impugned order dated 26.05.2016 passed by the learned Principal Judge, Family Court, Patna in Matrimonial Case No. 794 of 2012, whereby the learned court below directed the petitioner to pay monthly maintenance of Rs. 3000/- per month for the wife and Rs. 3000/- per month for the children, who are living with the wife-respondent, under Section 24 of the Hindu Marriage Act.

4.

From perusal of the impugned order, the court below has passed the reasoned order considering all the submissions, which are being raised by the petitioner before this Court. 5.

It may be mentioned here that this Court is not exercising the appellate or revisional jurisdiction and, as such, cannot hold Panchayati and determine the monthly rate of maintenance under Section 24 of Hindu Marriage Act. I, therefore,

Patna High Court C.Misc. No.488 of 2016 (2) dt.01-09-2016 find no jurisdictional error in the impugned order or it cannot be said that the impugned order passed by the court below for maintenance under Section 24 of the Hindu Marriage Act, is excessive, exaggerated in view of day to day expenses in these days. Thus, this civil miscellaneous is dismissed. brajesh/- (Mungeshwar Sahoo, J) U
