1. Heard learned counsel for the petitioner and learned Law Officer for the Vigilance Department, Bihar, Patna.

2. The petitioner has preferred this application for grant of regular bail in connection with Cheriya Bariyarpur P.S. Case no. 333 of 2022, registered under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

3. As per the prosecution case, on the orders passed in CWJC no.15459 of 2014 by this Court, the matriculation certificate issued by the Bihar School Examination Board and

Patna High Court CR. MISC. No.66191 of 2023(2) dt.16-10-2023 2/3 on the basis of which the petitioner obtained his appointment as a teacher, genuineness thereof was enquired into from the Board and the same was found to be forged.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No forged certificate has been used/produced by him in obtaining his appointment as a teacher. He is in custody since 20.5.2023 and charge-sheet has been submitted in the case. The petitioner has no criminal antecedent.

5. The application for bail is opposed by learned counsel appearing for the Vigilance Department. It is submitted that on an enquiry being conducted, the certificate produced by the petitioner was stated to be forged by the Bihar School Examination Board.

6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having remained in custody for more than 4 months since 20.5.2023, charge-sheet having been submitted in the case and the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Cheriya Bariyarpur P.S. Case no. 333 of 2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten
