Patna High Court CWJC No.21191 of 2014 dt.06-09-2018 2/2 This application has been filed for quashing the order dated 03.06.2014 passed by Ist Additional District Judge, Kaimur at Bhabua in Miscellaneous Case No.04 of 2011 whereby and whereunder the Title Appeal No.12 of 1999/23 of 2000 which was dismissed on 28.07.2011 on account of non-prosecution was readmitted for hearing.

2. Heard learned counsel for the petitioners and the learned counsel for the respondents.

3. It appears that the aforesaid title appeal filed by respondents was dismissed on 28.07.2011. The respondents filed Miscellaneous Case No.04 of 2011 for setting aside the said order. The learned court below issued notice upon the Opposite Parties who did not appear to oppose the submissions. The learned appellant court on being satisfied with the ground for non-prosecution of the appeal, has allowed the miscellaneous case and readmitted the appeal. The order re-admitting the appeal is well reasoned and requires no interference under the inherent jurisdiction.
