Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 307, 379, 504 of the Indian Penal Code.
The prosecution case is that the accused persons variously armed came and made assault to the husband of the informant. The specific accusation of assault to the husband of the informant is against co-accused Rameshwar Sah. It is further alleged that when the informant went to rescue while her husband was being assaulted, the petitioner and Rani Devi snatched the gold chain and ear ring of the informant.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.35428 of 2015 (2) dt.20-08-2015 2/2 petitioner that the postmortem report reflects only one injury which is attributed to the co-accused Rameshwar Sah and since petitioner is wife of Rameshwar Rah, hence she has been roped in the present case.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that specific accusation of assault is against co-accused Rameshwar Sah, husband of the petitioner, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bangaon P.S. Case No. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
