JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhagalpur Rail (G.R.P.S.) P.S. Case No. 24 of 2016, registered under Sections 379 and 411 of the Indian Penal Code. The accusations is that in course of boarding in Train No. 12254 UP (Yaswantpur Bhagalpur Express) by the informant, one person picked his pocket Rs. 1120/-, when the informant felt about pick pocket then he turned back and saw this petitioner was fleeing. On chase, this petitioner was apprehended and on search Rs. 1120/- was recovered along with one small scissor and Rs. 14500/- along with a mobile phone was also recovered from the possession of the petitioner, which

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case by the informant due to hot talk exchanged between the parties in course of taking seat in general compartment of the said train. The petitioner having no criminal antecedent is in custody since 30.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Bhagalpur in connection with Bhagalpur Rail (G.R.P.S) P.S. Case No. 24 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
