The petitioner is languishing in custody in a case registered for the offences punishable under Sections 417, 418, 419, 420, 384, 170, 171, 120(B)/34 of the Indian Penal Code.

It is alleged against the petitioner that he went at the house of the informant in a police uniform and pressurized and threatened to withdraw the case which was filed by the informant against one Manish Kumar. Subsequently, from the house of the petitioner, several police uniforms were recovered.

Patna High Court CR. MISC. No.72514 of 2024(2) dt.17-10-2024 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. As per allegation, there is no iota of wrongful gain or wrongful loss to anyone by alleged cheating. During investigation, it has also not came in light that petitioner has extorted or demanded any illegal amount to any person or the informant itself. The petitioner was not arrested in a police uniform and whatever articles were seized, it were seized in a rented room of the petitioner. The charge-sheet has already been submitted. The petitioner is languishing in custody since 29.06.2024.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount

Patna High Court CR. MISC. No.72514 of 2024(2) dt.17-10-2024 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Biharsharif P.S. Case No. 500 of 2024, subject to the conditions that (i) one of the bailors will be the close family member of the petitioner (ii) petitioner will physically present on each and every date before the trial Court till framing of the charge.
