JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 02.06.2015 in connection with Fatehpur P.S. Case No. 113 of 2015 for the offences instituted under Sections 341, 323, 307, 504 and 506 of the IPC.

The prosecution story, in brief, is that the petitioner alongwith other accused assaulted the informant Vijay Kumar Singh with Iron angle over his head and caused injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 02.06.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence

Patna High Court Cr.Misc. No.35495 of 2015 (3) dt.05-10-2015 2/2 against the petitioner. From perusal of paragraph no. 30 of the case diary, it would appear that the injuries upon the victim are superficial in nature in the opinion of the doctor. The injury nos. 1 and 2 are simple but from perusal of C.T. Scan report, it appears that the injury no. 1 is grievous. There is an admitted land dispute between the parties. It is further submitted that the matter has been compromised between the parties which is evident from perusal of Annexure-2 to the present application.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Fatehpur (Gaya) P.S.
