The petitioner apprehends his arrest in Rivilganj P.S. case No. 192 of 2015 under Section 285,307 and other Sections of the Indian Penal Code.
The informant, a police official, alleged that during Durga Puja immersion some persons entered in the procession and started creating trouble. The mob caught one person and brutally assaulted him.
It is submitted that for the same occurrence Rivilganj P.S. case No. 191 of 2015 was registered but petitioner has already been granted anticipatory bail in that case vide order dated 25.05.2016 passed in Cr. Misc. No. 22426 of 2016. There is no specific allegation against the petitioner. Similarly situated
Patna High Court Cr.Misc. No.30260 of 2016 (2) dt.09-09-2016 2/2 accused Shiv Sah and Salit Kumar have also been granted anticipatory bail vide order dated 29.08.2016 passed in Cr. Misc. No. 29598 of 2016 and the case of petitioner stands on same footing.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Saran at Chapra in Rivilganj P.S. Case No. 192 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
