JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard Shri Rajesh Kumar Sinha, learned counsel for the petitioner and Shri Anirban Kundu, SC-24, learned counsel for the State.

The learned counsel for the petitioner has submitted that the petitioner has not been paid his retiral benefits, although he has stood retired on 30.06.2014.

Per contra, the learned counsel for the State, particularly

Patna High Court CWJC No.18008 of 2019(3) dt.15-06-2020 2/2 respondent nos. 3 to 5, by referring to the counter affidavit in question has submitted that except G.P.F. entire retiral dues of the petitioner has been paid.

The learned counsel for the petitioner does not dispute the aforesaid position existing on fact, however, he submits that direction be issued for payment of the G.P.F. amount along with up to date statutory interest and the petitioner be granted liberty to agitate his subsisting grievances before the concerned authorities.

Accordingly, the respondents are directed to ensure payment of the G.P.F. amount along with the up to date statutory interest within a period of four weeks from today, failing which the defaulters shall not draw their salary.

The present writ petition stands disposed off with further liberty to the petitioner to agitate his subsisting grievances, if any, before the appropriate authorities.
