The petitioner apprehends his arrest in connection with Lakhisarai (Kabaiya) P.S. Case No.530 of 2021, registered for the offences punishable under Sections 323, 308, 341, 379, 504 and 34 of the Indian Penal Code.

The petitioner is said to have assaulted the informant by means of iron rod on his head causing bleeding injury. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is case and counter case between the parties and both sides sustained injuries. Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.64773 of 2022(2) dt.17-01-2023 2/2 anticipatory bail of the petitioner by submitting that from perusal of the impugned order, it is clear that injury sustained by the informant is grievous in nature.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
