The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414, 467, 468 and 471 of the Indian Penal Code.
Recovery of stolen motorcycle is alleged from possession of full brother of petitioner, namely, Kishan Kumar, who disclosed that he and petitioners are running a shop. Thereafter, from near the shop, a motorcycle was recovered by police. Petitioner has got no criminal antecedent. Considering that there is no direct and circumstantial material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the
Patna High Court Cr.Misc. No.79484 of 2018(2) dt.23-01-2019 2/2 order be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Asarganj Police Station Case No. 61 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
