The petitioners seeks bail in Paliganj P.S. Case No.228 of 2019, registered under Sections 398 and 401 of the Indian Penal Code as well as under Sections 25(1-b) A/26/35 of the Arms Act.

The informant in course of patrolling got information that some miscreants had assembled in the eastern side of Lalganj Sehra with a view to commit road robbery and on such went there to search out the place, on chase apprehended three persons, namely, Niranjan Kumar, Pappu Kumar and Rahul Kumar, the petitioner, and recovered arms and ammunition from possession of all the three accused persons. From possession of the petitioner, one loaded country made pistol was recovered. Learned counsel for the petitioner submits that the

Similarly situated other two accused persons, namely, Niranjan Kumar and Pappu Kumar have been granted regular bail by a coordinate Bench of this court vide order dated 17.10.2019, passed in Cr. Misc. No.64684 of 2019. The case of the petitioner stands on the same footing.

Having considered the facts that the petitioner has already remained in jail for more than five months and similarly situated co-accused persons have been granted bail, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Danapur, Patna in connection with Paliganj P.S. Case No.228 of 2019.
