2. Petitioners seek regular bail in connection with Lalganj P.S. Case No. 207 of 2024 dated 15.07.2024 registered for the offences punishable under sections 308(4) and 308(5) of the Bharatiya Nyaya Sanhita ( in short 'BNS').

The main submissions advanced by learned counsel for the petitioners are that the names of both the petitioners have surfaced in the confessional statements of co-accused persons except this, there is no material to connect them to the alleged offence of extortion demand and both the petitioners have no

No.65765 of 2024(4) dt.13-12-2024 2/3 connection to the mobile numbers which were allegedly used in making the alleged extortion demand and co-accused persons namely, Dinesh Sahni and Gautam Kumar having similar nature of allegation have been granted bail by this Bench vide order dated 29.11.2024 passed in Cr. Misc. No. 66775 of 2024 and Cr. Misc. No. 75109 of 2024 respectively. It is further submitted that the petitioners have been languishing in jail since 22.07.2024 having fair and clean antecedent and against them, investigation has been completed.

Though learned APP for the State has opposed the prayer for bail of the petitioners but fairly accepted that except the confessional statement of co-accused persons mentioned in the paragraph nos. 39, 41, 60 and 72 there is no material against the petitioners and investigation has been completed against them.
5. Considering the above submissions made by petitioners' counsel and also the fact that the case of the petitioners is identical to that of the above-mentioned coaccused persons who have been granted bail by this Bench, this court is inclined to release the petitioners on bail. Accordingly, let the petitioners named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand)
Patna High Court CR. MISC. No.65765 of 2024(4) dt.13-12-2024 3/3 each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Lalganj P.S. Case No. 207 of 2024.
