This application is for cancellation of anticipatory bail granted to opposite party no. 2 Surendra Kumar Verma in connection with Complaint Case No. 2866(C) of 2015 pending in the court of learned Chief Judicial Magistrate/Judicial Magistrate, Patna.
Prayer for consideration is on the ground that in the order dated 14.12.2016 passed in Cr. Misc. No. 53787 of 2016, this Court has observed while granting bail that there is dispute of real location of land purchased by the complainant whereas true fact is that the complainant has not purchased any land and the complainant has come forward on behalf of the land owner from whom the father of the opposite party no. 2 had purchased the
Patna High Court Cr.Misc. No.15303 of 2017 (5) dt.08-11-2017 2/2 land. In fact, the land to be sold was coming under the high voltage wire crossing above the proposed land whereas the father of the opposite party no. 2 got executed sale deed in respect of the land by the side of the agreed land which is clear from the range of any high voltage wire and is costly one.
The aforesaid cannot be a ground to cancel the bail already granted to opposite party no. 2. Hence, this application stands dismissed.
