The petitioner apprehends his arrest in Maniyari P.S. Case No.52 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a), 38 and 41 of Bihar Prohibition and Excise Act.
The police intercepted a Maruti Van from which 187.500 liters illicit liquor was recovered. Sanjay Ram, the driver of the vehicle was also apprehended on the spot. The learned counsel for the petitioner submits that petitioner is owner of the vehicle. The petitioner handed over the vehicle to the driver to ply the vehicle on hire but the driver was illegally carrying liquor.
Considering the aforesaid facts and nature of allegation made against the petitioner, let the petitioner, above
Patna High Court Cr.Misc. No.80139 of 2018(2) dt.15-01-2019 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge(Excise), Muzaffarpur in connection with Maniyari P.S. Case No.52 of 2018(G.R. No.246 of 2018), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
