In this case, the petitioner is seeking bail in connection with C.A. Case No. 774C/2013 registered for offence under section 420 of the Indian Penal Code and section 138 of the N.I. Act.
The petitioner has business connection with the complainant.
As per the allegation, the petitioner had given the cheque of Rs. 5,08, 543/- to the complainant, which was returned by the Bank due to insufficient balance.
Patna High Court Cr.Misc. No.28627 of 2016 (2) dt.26-07-2016 The matter relates to N.I. Act. The counsel for the petitioner submits that the petitioner is ready to return the amount which the complainant is entitled to.
Looking to facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Khagaria in connection with C.A. Case No. 774C/2013, subject to the condition as laid down under Section 438 (2) Cr. P.C.
