====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 01-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Digha P.S. Case No.102 of 2015 registered under Section 379 of the Indian Penal Code.

Regarding the theft of the vehicle of the informant in the night of 09/10.04.2015 from his door, the present case was instituted on 10.04.2015 against unknown under Section 379 of the Indian Penal Code.

Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.55946 of 2017 (2) dt.01-12-2017 2/2 petitioners are not named in the F.I.R. In course of investigation, one Md. Aslam alias Md. Juhi was apprehended by the police in connection with another case, who confessed his guilt in that case disclosing his involvement in five other cases including the present case in association of the petitioners and one Kunal alias Ramesh and two others. Except that, nothing has been collected by the Investigating Officer against the petitioners in course of investigation. Except the cases, as detailed in paragraph-3 to this application, the petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Patna, in connection with Digha P.S. Case No.102 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
