The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379, 323, 395 and 411 of the Indian Penal Code. The accusation is of robbing books and other articles worth rupees twenty lakhs from Urdu Library. It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation
Patna High Court Cr.Misc. No.35529 of 2015 (2) dt.03-09-2015 2/2 has been levelled as Eviction Suit No. 02 of 2014 is pending between the parties and Municipal authorities have reported to the Munger Kotwali police that the property in question is recorded in the revenue records in the name of Khago Mistry, the grand father of the petitioners.
Considering the accusation levelled in the background of serious land dispute, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Munger Kotwali P.S. Case No. 117 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
