JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 02.11.2015 passed in Cri. Misc. No. 26886 of 2015, on the ground that the petitioner is suffering in custody since 21.04.2015 only on suspicion, the petitioner has been named, to which the learned A.P.P. seriously opposes by submitting that petitioner was seen at once by the informant and his wife, coming out from the room of their son and fleeing away with Chappat (meat cutting instrument), and in side the room the neck of his son was found cut, due to which he succumbed to the injuries.

In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.34313 of 2016 (3) dt.19-10-2016 2/2 considering the report of learned Additional Sessions Judge 6th, Vaishali, Hajipur, the trial is in progress and it is likely to be concluded within nine months and, as such, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected.

However, the learned trial court is directed to expedite the trial and conclude the same preferably within nine months.
