Heard learned counsel for the petitioner and the 03.03.2015.
State.
Petitioner is an accused in a case under Sections 409, 420 and 353 of the Penal Code. He is said to have misappropriated the scholarship amount to the tune of Rs. 1,66,000/- and odd, Mid Day Meal amount of Rs. 88,000/- and odd.
Let petitioner, named above, be released on provisional bail on furnishing bond of Rs. 5,000/- (Five thousand) with two sureties of the like amount each to the satisfaction of Sri R.B. Narayan, Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S. Case No. 146 of 2014, G.R. Case No. 1619 of 2014, thereafter deposit the aforesaid amount in the court below within three months from the date of his release from jail
Patna High Court Cr.Misc. No.46698 of 2014 (3) dt.03-03-2015 2/2 custody, the deposit shall be invested in a fixed deposit with a Nationalized Bank so as to earn interest, the deposit shall be subject to the result of the trial. In case petitioner is acquitted in the trial, the amount deposited together with interest will be given to the petitioner. It is made clear that if the aforesaid amount is not deposited in the court below within three months from the date of release, petitioner must surrender in the court below. (V.N.Sinha,J.) P.K.P.
