2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302/34 of the Indian Penal Code, registered in connection with Patepur P.S. Case No. 44 of 2021.

3. The allegation against the petitioner along with others is of killing the son of the informant by poisoning.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. He submitted that petitioner is not the family members of the wife of the deceased rather he is a covillager. Petitioner has no concern with the alleged occurrence,

He further submitted that from supervision note which is incorporated with the case diary, it appears that there was some dispute between the deceased and his wife due to which the husband (deceased) purchased some intoxicating substance from the market and consumed it. Moreover, petitioner is a person of clean antecedent and he is in custody since 10.07.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case as well as petitioner has clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII-cumSub-Judge-XIV, Vaishali, Hajipur in connection with Patepur P.S. Case No. 44 of 2021, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
