JUSTICE SUDHIR SINGH ORAL ORDER 16-04-2015 The petitioner is apprehending his arrest in connection with Kotwali (Adampur ) P.S.Case No. 492 of 2014 registered for the offences under Sections 467, 468 and 424 of the Indian penal Code.

Heard learned counsel for the petitioner and the State. It has been alleged that the petitioner fraudulently got Rs. 20,000/- and Rs. 21,000/- withdrawn from the Bank account of Dipti Bhattacharya, who happens to be the Bua of the informant. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case and except for suspicion there is nothing against him. On behalf of the State it has been vehemently opposed and submitted that the petitioner is named in the FIR.

No.45538 of 2014 (3) dt.16-04-2015 2/2 Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest or surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in Kotwali (Adampur ) P.S.Case No. 492 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. and with a further condition that within a period of four weeks he shall deposit an amount of Rs. 10,000/- (ten thousand) before the court below, which will be subject to the final result of the case, failing which the court below will be at liberty to take necessary steps against the petitioner.
