JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 28-08-2023 Heard Mr. Manoj Kumar, learned counsel appearing on behalf of the petitioner and Mr. Manoj Kumar Singh, Mr. Ankit Kumar Singh, learned counsels appearing on behalf of the Union of India and Dr. Pankaj, learned counsel appearing on behalf of respondent no. 2.

2. Supplementary affidavit has been filed on behalf of respondent no. 1 is directed to be kept on record.

3. Learned counsel appearing on behalf of the petitioner informs this Court that the grievance of the petitioner

Patna High Court CWJC No.380 of 2019 dt.28-08-2023 2/3 has been redressed by Controller of Communication Account, B.S.N.L, respondent no. 1 and letter has already been issued to the Branch Manager, Punjab National Bank, Gaura Branch, Bhojpur, Arra.

4. It is admitted that the Bank and the State Government has entered into agreement and due to incorrect calculation by them, the petitioner has been made to face the consequences as a result of incorrect calculation made by the State Government and the Bank leading to illegally recover of the amount from the petitioner.

5. The Branch Manager, Punjab National Bank, Gaura Branch, Bhojpur, Arra is directed to credit the entire amount in terms of letter issued by respondent no. 1 vide letter dated 29.11.2011 as contained in Annexure-2 to the writ petition within a period of one week.

6. The Branch Manager is further directed to abide by the circulars of the Reserve Bank of India issued from time to time, in which it has been directed to all the Banks that they will not fail in crediting and disbursing the retiral dues to which the pensioners are entitled for.

7. In case of failure, the petitioner is at liberty to take appropriate legal action against the Branch Manager concerned.

8. With the above observation and direction the writ petition stands disposed of.
