In the present writ application, the petitioner is seeking relief against the BISCOMAUN. The BISCOMAUN is a cooperative society registered under the Bihar and Orissa Cooperative Society Act and it is also an admitted fact that the BISCOMAUN has not been superseded nor any administrator has been appointed by the State in exercise of power under Section 41 of the Bihar and Orissa Cooperative Societies Act, 1935. In view of Special Bench Judgment of this Court in the case of The Organizer, Dehri C.D. & C.M. Union Limited Vs. The State of Bihar & Ors. reported in 2014(1) PLJR 695, the present application is not maintainable.

Patna High Court CWJC No.12219 of 2015 (2) dt.12-05-2016 This writ application is, accordingly, dismissed. The petitioner if so advised may approach to the authority for redressal of his grievance.
