2. In this case, the petitioners are seeking regular bail in connection with Town P.S. Case No. 209 of 2024 registered for the offences punishable under Sections 414, 201/34 of the Indian Penal Code and Section 8(c), 21(b) of the N.D.P.S. Act.

3. As per allegation, during patrolling, two persons were apprehended on suspicion who disclosed their name as Md. Suhail (petitioner no.2) and Akash Das. On search, 3.9 gram smack along with a master key of motorcycle was recovered from the possession of petitioner no.2 and 3.1 gram smack along with a master key of motorcycle was recovered from the possession of Akash Das. On stiff interrogation, both confessed the name of Md. Muzahid @ Mojahid

Patna High Court CR. MISC. No.66877 of 2024(2) dt.26-09-2024 2/2 (petitioner no.1) who engaged in selling the stolen motorcycle. Thereafter, on search, 2.9 gram smack and a master key of motorcycle was recovered from the possession of petitioner no.1.

4. The learned counsel for the petitioner has submitted that the petitioners are a person of clean antecedent and they have falsely been implicated in this case. The recovery of smack is less than the commercial quantity. The petitioners are under custody since 20.03.2024.

5. Considering the nature of allegation as well as period of incarceration, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-1 (NDPS), Muzaffarpur in connection with Town P.S. Case No. 209 of 2024, subject to the following condition:- (i) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
