The petitioners are apprehending their arrest in connection with Amarpur P.S. Case No. 155 of 2016 for offence under Sections 114, 147, 188, 341, 323, 332, 337, 353, 435, 427 of the Indian Penal Code.

The brief fact of this case is that the Deputy S.P. (Probation) cum S.H.O., Amarpur police station received information that on account of road accident with a tractor, one female and one minor child have been killed. The villagers have jammed the road and resorted to violence. It was informed that large numbers of persons have assembled there.

Patna High Court Cr.Misc. No.28677 of 2016 (2) dt.26-07-2016 It is an admitted fact that there is no specific allegation against the petitioners.

Looking to the entire facts and circumstances of the case, let the petitioners, namely, Niranjan Singh, Gourav Singh @ Matra Singh and Sanjeev Singh, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 155 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
