2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

3. As per prosecution case, four unknown persons are said to have surrounded the informant while he along with others were going by his car. The accused miscreants looted cash of Rs. 30,000/- and mobile phone from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in FIR. He has falsely been implicated in this case on the basis of his self confessional statement. Neither the petitioner was put on TI parade nor any incriminating article

Patna High Court CR. MISC. No.65680 of 2023(3) dt.01-12-2023 2/2 has been recovered from his conscious possession. The petitioner has got no criminal antecedent as stated in para-3 of the petition. It is further submitted that the petitioner is languishing in judicial custody since 24.6.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with suppi P.S. Case No. 152 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sitamarhi or concerned Court.
