The present application has been filed for modification of the order dated 29.11.2018 passed in Cr.Misc.No. 54943 of 2018, by which the petitioner was granted anticipatory bail in connection with Parbatta P.S. case No.259 of 2018, pending in the court of Additional Chief Judicial Magistrate 1st, Khagaria and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the counsel for the petitioner that in the main petition, the name of father of petitioner has wrongly been mentioned as 'Late Jagdev Yadav'

Patna High Court Cr.Misc. No.12 of 2019(2) dt.10-01-2019 2/2 in place of 'Dinesh Yadav' and due to that, same mistake occurred in the order dated 29.11.2018 passed in Cr.Misc.No. 54943 of 2018.

Accordingly, the order dated 29.11.2018 passed in Cr.Misc.No. 54943 of 2018 stands modified to the extent that father's name of petitioner be read as 'Dinesh Yadav' in place of 'Late Jagdev Yadav'.

It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioners could surrender and furnish bail bond in the court below.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order well be same.

The modification application is, accordingly, disposed of.
