====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 17-01-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Jakkanpur P.S. Case No. 402 of 2025, registered for the offences punishable under Sections 85, 80(2), 102, 3(5) of the BNS, 2023.
3. The case of the prosecution, in short, one Kamlesh Yadav gave written report before station house office alleging therein that he solemnized marriage of his daughter in the year 2024. It is further alleged that informant in laws started demanding dowry and to settle the issue informant gave one lakh rupees. It is further alleged that two days prior to the
Patna High Court CR. MISC. No.60851 of 2025(4) dt.17-01-2026 2/3 occurrence, in laws forcefullly cut hair of the daughter of the informant and restricted her to made call to her family members.
4. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent. The entire prosecution story is false, fabricated and concocted. Learned counsel for the petitioners submits that there is no manner of occurrence as alleged has ever taken place. It is further submitted that husband of the deceased namely Ranbir Kumar is already in custody.
5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.
6. Considering the fact that there is a general alegation against the petitioners. No specific allegation of torture committed by them has been alleged and also the fact that in the postmortem report it has come that the deceased most likely committed suicide by hanging herself. Under these circumstances, this Court is inclined to grant privilege of anticipatory bail to the petitioners.
7. Let the petitioners, named above, in the event of their arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.60851 of 2025(4) dt.17-01-2026 3/3 Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VIII, Patna in connection with Jakkanpur P.S. Case No. 402 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
