JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner carries criminal antecedent but the only accusation against him is that at his instigation, other F.I.R. named accused made indiscriminate firing. Admittedly, at the time of alleged occurrence, petitioner was lodged in jail in connection with another case.

It is pointed out on behalf of the petitioner that two days prior to the alleged occurrence, a dacoity was committed in the house of the petitioner for which mother of the petitioner lodged Charpokhari P.S. Case No. 125 of 2015 against the prosecution party and moreover, in the year 2001, father of the petitioner was killed for which Charpokhari P.S. Case No. 38 of

Patna High Court Cr.Misc. No.37405 of 2015 (3) dt.10-09-2015 2/2 2001 was lodged against Sunil Paswan and Shankar Paswan who happened to be associates of informant of the present case and on 28.04.2015, one of the accused of the aforesaid case was convicted and after that the present case was lodged against the petitioner and others.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 126 of 2015.
