ANJANA MISHRA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with CII Case No.2037 of 2013/Trial No.380/2016, arising out of RPF Post-Purnea Case No.140 of 2013 registered for the offence under Sections 145, 146, 147, 153 and 174(a) of the Railway Act.

Learned counsel for the petitioner submits that the allegation is of having disrupted railway traffic at KS-65 when Simanchal Express was crossing the said point. The F.I.R. is against the entire mob but, subsequently, the name of the petitioner has also come in course of inquiry.

No.31369 of 2016 (3) dt.01-09-2016 2/2 Considering the nature of allegations made and that the petitioner is said to be one of the members of the mob, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Katihar, in connection with CII Case No.2037 of 2013/Trial No.380/2016, arising out of RPF Post-Purnea Case No.140 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
