JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, it was coaccused, Kailash Das, who gave fatal blow on the head of the deceased and so far as petitioner is concerned, he is said to be member of unlawful assembly. Admittedly, having similar allegation, one co-accused, namely, Ramchel Das has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.36047 of 2015 (2) dt.27-08-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 318 of 2014.
